1. Eligibility

1.1

At the time of registration and audition, any participant in the Program must either-

1. Be a Nigerian citizen.
2. Be a legal permanent resident of Nigeria
3. Possess a current work permit
4. Otherwise be in Nigeria legally at the time of initial audition.

All participants in the Program will be required to show proof of unrestricted employment authorisation or have appropriate visa status in Nigeria that allows them to compete in the Program prior to the show.

1.2

Any participant in the Program or reward that is under the age of eighteen (18) MUST have his or her parent or legal guardian’s permission to apply and participate in the audition and/or Program, reward, vote or poll. The parent/legal guardian may be asked to show proof that she or he is the parent or legal guardian and be authorised to bind the participant to the terms of these Terms & Conditions.

1.3

Employees and members of their immediate families (including live-in partner) of the Promoter, companies within the Promoter and/or those associated with the operation or promotion of the Program or reward or auditions, including without limitation the provider of the prize or the Producer of the programme, are NOT eligible to participate in the Program or reward.

1.4

The Promoter reserves the right in its sole discretion to ask for evidence to verify the age, identity and/or eligibility of any participant at any time, and to use any channels and methods available to carry out checks of any details provided. The Promoter may withhold registration confirmation, delivery of a prize or refuse a participant participation in the auditions until it has received such evidence from the participant and failure to provide such evidence in a timely manner may result in disqualifying a participant. Charges will still apply as well as forfeiture of the prize or reward.

1.5

The Producer and/or the Promoter reserve the right to remove from the Program or reward any person who the Producer and/or the Promoter determines, in the Producer or the Promoter ’s sole discretion, is sufficiently connected with the Program or a Producer or the Promoter; or any other person or entity connected with the production, administration or judging of the auditions or the Program or the reward or the network that may air or otherwise exhibit the Program; any person or entity involved in the development, production, distribution or other exploitation of the Program; any sponsor of the Program or any person or entity supplying services or prizes to the Program, such that such person’s participation in the Program or the reward could create the appearance of impropriety.

1.6

Conversely, the Producer and/or the Promoter reserves the right to allow any person to remain as part of the Program who may have a connection with the Program or any of the Producers if, in the Producer’s and/or the Promoter’s sole discretion, the Producer and/or the Promoter determines that such person’s involvement in the Program does not and will not affect the integrity of the Program.

1.7

You acknowledge and agree to abide by the rules, regulations, terms and condition for this competition as determined by the Producer (‘the Rules’) and you acknowledge that the Producer reserves the right in its sole discretion to modify or change the eligibility requirements from time to time and such modifications will be effective upon posting to the website.

1.8

The Producers’ decisions regarding all elements of the application process, the competition and the Program shall be final and binding.

2. Entry

2.1

The opening and closing date and time for votes are as shown on http://www.liveyourdreamnigeria.com/. Any votes received before the competition opens or after the closing date and time will not be counted but may still be charged.

2.2

All applications can be made online at http://www.liveyourdreamnigeria.com/

2.3

The Producer may in its sole discretion include additional methods of application at any time and the closing dates for applications will be as stated in the interaction information.

2.4

Please note that outside of the application process, participants may also be invited to audition for the Program by researchers acting on behalf of the Producer. Such entrants will be required to go through the audition process and the Program Rules will apply.

2.5

The participants must answer the questions or complete tasks specified and complete the application form.

2.6

The participants shall be required to provide their full name, contact telephone number, email address and/or any other information as specified at the time of entering the competition. This information cannot be amended once a participant has submitted and completed registration.

2.7

Each participant in the Program will be charged N1500 (One Thousand Five Hundred Naira) being the cost of entry. N1500 is non-refundable whether you are selected or not. Entry does not in any way imply or guarantee selection, all selection is solely on performances.

2.8

Any entries which are above the maximum number of entries as specified above or which are incomplete, without all the required information, illegible, inaudible, incomprehensible, incorrectly submitted, lost, damaged in any way, made or received by the Promoter or are not otherwise in accordance with the terms and conditions are invalid and will be discounted.

2.9

In the event of any fault, mistake, misunderstanding or dispute concerning the correctness or acceptability of any answers given by participants, or the operation of any part of the competition, the decision of the Promoter shall be final.

2.10

Participants are required to submit a contribution (which may include but is not limited to photograph(s), video, audio, live-media images as part of their entry. It is recommended that participants send in copies rather than original material as such material will not be returned unless otherwise specified in the interaction information.

2.11

The Producer, the Promoter, their agents and sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any online entry, telephone network or line, system, server, provider or otherwise which may result in any messages or entry not being properly received or recorded.

2.12

Participants will be selected and invited to attend an audition at a time and location to be decided at the sole discretion of the Producer whose decision will be final and binding.

2.13

The completion of an entry or application does not guarantee that an entrant will receive an audition or participate in the Program. Only one entry per candidate is allowed.

2.14

Please note that to audition for the Program you must be at least 16 years old by the time of the Show(1st August ) (or any later closing dates as specified by the Producer).

2.15

If you are under 18 years, please make sure that you get the permission of your parents or legal guardians before applying.

2.16

If you are under 18 years and you are invited to audition, you must be accompanied by a parent or legal guardian at the audition. Proof of age will be required at the auditions. If the audition dates are during school term times, it is your responsibility to obtain confirmation of authorised leave of absence during school term times from your school. The Producer and/or the Promoter will not be liable where you do not obtain such authorisation.

2.17

You must have the right to be in Nigeria and perform in the Program and if you progress to the final stages of the Program, the right to live and work in Nigeria. You must be able to demonstrate that you have this right on request by the Producer at any time and you agree to notify the Producer immediately of any change of your immigration status.

2.18

In the event that you are invited to attend an audition you hereby irrevocably grant all consents necessary for the Producer to film and record such audition and to use recordings featuring your contribution, including without limitation your image and/or voice, in connection with the Program and/or ancillary rights in the Program and to exploit the same in all media throughout the world in perpetuity without the need for payment to you. You agree to waive any moral rights that may exist in relation to your contribution. You acknowledge that you understand the style, nature and format of the Program and that we reserve the right to show all auditions whether successful or unsuccessful.

2.19

Should you be selected to take part in the Program you agree and undertake to enter into further contracts with the Producer and you agree to abide by the terms thereof.

2.20

All personal details and/or information given in your application either in the application form or otherwise must be truthful, accurate and in no way misleading.

2.21

The Producer reserves the right to disqualify you if you have supplied untruthful, inaccurate or misleading personal details and/or information, have failed to abide by the Rules and/or are in breach of these terms and conditions.

2.22

You will not, without the Producer’s prior written consent, disclose, publish or discuss with any third party any information relating to the Program, your appearance in the Program, the production team or any participants in the Program or any other information which may come to your attention including without limitation in relation to the presenter, the Producer or otherwise save where such information is already in the public domain.

2.23

You must disclose to the Producer details of any conviction. You shall notify the Producer immediately if there are any criminal charges brought against you or if any information you provide in your application becomes inaccurate between now and the date of first transmission of the Program.

3. The Prize

3.1

The prize is as specified in the interaction information.

3.2

The prize is subject to winner confirmation i.e. the Promoter has contacted the winner and confirmed his/her eligibility to receive the reward.

3.3

The prize is also subject to the terms and conditions of the prize provider, their agents and where applicable to the terms of the location and/or the manufacturer.

3.4

Any elements of the prize including travel and/or accommodation will be subject to availability. Certain dates may be excluded when the winner may not take up the prize. Where the prize involves travel or accommodation on a date and/or to a destination to be chosen by the winner, the Promoter reserves the right to determine a final date by which the prize must be taken. Where the prize necessitates travel and/or attending an event on a specific date, the winner must be available on the date(s) specified by the Promoter in the interaction information and no alternative dates will be available.

3.5

Unless otherwise specified, all elements relating to a prize including travel and/or accommodation must be taken up during one period, and not on non-consecutive dates. The winner (and their companion(s) if applicable) will be required to hold a valid passport, any required visas and/or other necessary travel documentation. Where the prize relates to travel for more than one person, the winner and their companion(s) must travel together, departing from and returning to the same location at the same time and on the same itinerary. The prize provider and/or their agents cannot guarantee that seats will be adjacent to each other.

3.6

Where the prize includes a cheque, voucher or gift card, such prize will be made payable in Nigeria Naira in the name of the winner only and such cheque, voucher, or gift card cannot be made payable to any third party. No other form of payment other than that indicated in the interaction information will be provided to the winner.

3.7

The Promoter, the prize provider or the issuer of the vouchers or gift cards and their agents reserve the right to refuse to redeem vouchers and/or gift cards which are deemed to have been tampered with, defaced, duplicated, damaged or which otherwise are suspected to be affected by fraud or which have been lost or stolen following delivery.

3.8

The winner (and where applicable, their companion(s)) is (are) required to comply with all instructions and requirements as may be specified by the Promoter or any authorised third party to receive and/or take up the prize, including but not limited to providing responses within specified time frames, adhering to the itinerary, completing any required forms and delivering any required documentation. The Promoter will not be liable to the winner or any other persons where they fail to comply with such instructions and such failure may result in forfeiture of the prize or the reward.

3.9

The winner (and where applicable, their companion(s)) may be required to provide their signature as proof of their agreement to relevant waivers, releases and/or consents when taking up the prize or reward. Failure to sign any relevant documentation may result in forfeiture of the prize or reward.

3.10

The prize or reward excludes all other costs and arrangements not expressly included in the prize or reward (as stated in the contract information). Additional charges and expenses incurred for goods, services, attractions, facilities, upgrades, activities and events not expressly included in the prize or reward are payable solely by the winner (and where applicable their companion(s)). The Promoter will not be held liable where such charges and/or expenses are incurred, and no refund or reimbursement will be made. The Promoter will accept no responsibility where the winner is unable to pay in full any such charges and/or expenses.

3.11

For delivery of the prize or reward, you may be required to be available at a specified time and place.

3.12

No cash equivalent or alternative prize or reward will be given at the request of the winner. The prize or reward is non-transferable and non-exchangeable. If the winner decides to take up and sell the prize (where such sale is permitted) the Promoter will not be required to provide any guidance on such sale, and the winner acknowledges that the sale price may be lower than the retail or advertised price. However, the Promoter reserves the right to change the prize or reward or any part of the prize or reward to an alternative of equal or greater value for any reason in its sole discretion including without limitation due to circumstances beyond its control or if any part of the prize or reward becomes unavailable. If for any reason the winner chooses not to take up the prize or reward or any part of the prize or reward, the Promoter reserves the right to ask the winner to confirm this in writing and, whether or not such confirmation is received, the Promoter will retain or dispose of the prize or reward(or part of the prize or reward) at its own discretion.

3.13

The Promoter may refuse to provide a prize or reward, or if provided already, seek its recovery, if it finds that the winner is not entitled to the prize or reward under the contract terms and conditions or a participant’s breach of the interaction terms and conditions, fraud or dishonesty, including but not limited to the use of technology which enables aparticipant to evade applicable charges when entering the competition.

3.14

Unless the prize is time critical, the Promoter or the prize provider(s) shall endeavour to deliver the prize or reward to the winner within twenty-eight (28) days from the date of winner confirmation unless otherwise stated in the interaction information. If the prize or reward is time critical, the Promoter or the prize provider(s) shall endeavour to deliver the prize or reward to the winner as soon as reasonably practicable before the necessary time to take up the prize or reward.

3.15

The Promoter, the prize provider and their agents will not be liable where a prize has been lost, damaged or stolen following delivery and such prize will not be replaced.

4. Winner Selection

For the reward the winner will be unveiled at the closing ceremony of the Program unless otherwise specified in the interaction information. Unless stated otherwise in the interaction information, the winner of the Program will be the participant with the highest votes from all valid votes at the close of the Program, subject to eligibility and winner confirmation. The interaction information will detail the judging criteria through which the winner will be selected.

5. Winner Contact

5.1

General contact: The winner will be contacted as soon as practicable on or after the draw date or as indicated in the interaction information. Reasonable efforts will be made to contact a winner on the phone number provided when voting or such other method of contact deemed appropriate by the Promoter in its sole discretion in the circumstances. Unless the prize is time critical or time sensitive, the Promoter will try to contact the winner over a 4-week period.

5.2

Time critical: Where the prize must be taken up within 1 month of the close date of the competition, the competition will be considered “time critical”. As the winner needs to be found before the time to take up the prize elapses, the interaction information will indicate the date(s) when participants must be contactable and the Promoter will try to contact the winner on the phone number (or other method of contact (if appropriate)) provided, calling three times in a three-hour daytime period or as indicated in the interaction information.

5.3

Time sensitive: Where the prize must be taken up by a date which is more than 1 month but less than 6 months after the close date of the competition, unless otherwise stated in the interaction information the Promoter will try to contact the winner on the phone number (or other method of contact (if appropriate)) they provided over a two week period or as indicated in the interaction information.

5.4

If the winner cannot be contacted or successful contact is not made within the time periods set out in clauses 5.1 to 5.3 above or as otherwise set out in the interaction information (as applicable) or if the winner fails to meet any of the eligibility requirements or is otherwise unable to comply with the interaction terms and conditions, this may result in forfeiture of the prize and the Promoter reserves the right to disqualify that participant (without further liability to that participant) and offer the prize or reward to the next eligible participant and thereafter until a winner is found.

5.5

Any participantand/or winner must comply with any directions given to him or her by the Promoter, the prize provider(s) and/or their agents and with all relevant laws, rules and regulations, restrictions, itinerary, and where applicable, compliance with the Nigerian Broadcasting Corporation Act. Failure to comply with instructions, itineraries, rules, restrictions, requirements, laws and guidelines may result in an invalid entry and/or forfeiture of the prize.
